3. Legal Basis for Processing (GDPR)
If you are located in the European Economic Area (EEA), we process your personal data under the following legal bases:
- Contract performance: processing necessary to provide the service you signed up for (account management, monitoring, alerts)
- Legitimate interests: service improvement, fraud prevention, and security
- Consent: marketing and product update emails, which you may withdraw at any time
4. Data Storage & Security
Your data is stored on Amazon Web Services (AWS) infrastructure in the United States. We use industry-standard encryption in transit (TLS) and at rest. Access to production systems is restricted and audited. In the event of a data breach that affects your personal information, we will notify you by email within 72 hours of becoming aware of the breach, as required by applicable law.
5. Data Retention
Monitor history is retained according to your plan (7 days on Free, 30 days on Starter, 90 days on Growth, 180 days on Pro). Account data is deleted promptly upon account deletion. Expired trial accounts are automatically removed after 7 days.
6. Third-Party Services
We use the following third-party services to operate cloudPulsePoint:
- AWS (infrastructure, database, and email delivery) — AWS Privacy Policy
- Stripe (payment processing) — Stripe Privacy Policy
We do not sell your personal data to any third party.
7. International Data Transfers
Our servers are located in the United States. If you are accessing cloudPulsePoint from outside the United States, including from the EEA, your data will be transferred to and processed in the United States. By using the service, you consent to this transfer. We rely on AWS's compliance with applicable data transfer frameworks to safeguard your data.
8. Cookies & Analytics
We use browser localStorage to store your authentication session tokens. This is strictly necessary for the service to function — without it you cannot remain logged in. We do not use third-party tracking cookies, advertising pixels, or analytics services that share your data with third parties. No personal data is shared with advertising networks. You can clear your session at any time by logging out or clearing your browser's site data.
9. Children's Privacy
cloudPulsePoint is not directed to children under the age of 13. We do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us with personal information, please contact us immediately at support@cloudpulsepoint.com and we will delete that information promptly.
10. Law Enforcement Requests
We may disclose your personal information if required to do so by law or in good faith belief that such action is necessary to comply with a legal obligation, protect and defend our rights or property, prevent fraud or abuse, or protect the personal safety of users or the public. Where legally permitted, we will notify you before disclosing your data in response to such a request.
11. Your Rights
You have the right to access, correct, or delete your personal data at any time. You may delete your account directly from your account settings, or contact us at support@cloudpulsepoint.com to request a copy of your data or ask us to correct inaccurate information.
If you are located in the European Economic Area, you have additional rights under GDPR including data portability and the right to lodge a complaint with your local supervisory authority.
Business customers in the European Economic Area who require a Data Processing Agreement (DPA) may request one by contacting support@cloudpulsepoint.com.
If you are a California resident, you have rights under the California Consumer Privacy Act (CCPA), including the right to know what personal information we collect, the right to request deletion, and the right to opt out of the sale of personal information. We do not sell personal information. To exercise your CCPA rights, contact us at support@cloudpulsepoint.com.
